Acceptable Use Policy
The rules and expectations for using our services. Please read this policy carefully before proceeding.
Table of Contents
This Acceptable Use Policy ("AUP") governs the use of all services provided by CubiCloud ("CubiCloud", "we", "us", or "our"), including Minecraft and game server hosting, VPS/VDS services, web hosting, dedicated resources, storage, network services, APIs, and other related services (collectively, the "Services").
This AUP forms part of CubiCloud's Terms of Service. By using our Services, you agree to comply with this policy.
You are responsible for all activity conducted through your account, services, servers, and credentials.
Violation of this AUP may result in warnings, restrictions, suspension, termination, content removal, or reporting to relevant authorities, depending on the nature and severity of the violation.
1. General Requirements
You must use CubiCloud Services:
- In compliance with applicable laws and regulations;
- In accordance with our Terms of Service;
- Without interfering with our infrastructure or network;
- Without negatively affecting other customers;
- Without attempting to circumvent security or resource restrictions;
- Without engaging in fraudulent, abusive, or malicious activity; and
- In a manner that does not create unreasonable risks to CubiCloud or third parties.
You are responsible for all content, software, users, applications, and activities operated through your Services.
2. Prohibited Activities
You may not use CubiCloud Services to facilitate, conduct, distribute, or host activities that are illegal or abusive.
Prohibited activities include, but are not limited to:
- Malware, ransomware, spyware, trojans, or other malicious software;
- Phishing websites, fake login pages, or credential harvesting;
- Password theft or credential theft;
- Carding, payment fraud, or financial fraud;
- Identity theft or impersonation intended to deceive;
- Botnets or malware command-and-control infrastructure;
- DDoS attacks, stressers, or booters;
- Unauthorized access to computer systems or networks;
- Brute-force attacks against third-party systems;
- Unauthorized vulnerability exploitation;
- Network attacks or intentional service disruption;
- Distribution of pirated or illegally obtained software;
- Hosting or distributing copyright-infringing material without authorization;
- Content or services that violate applicable laws;
- Illegal marketplaces or services;
- Fraudulent schemes;
- Distribution of stolen credentials or personal information;
- Content involving the sexual exploitation of children;
- Credible threats of violence or other unlawful harmful activity; and
- Any activity intended to circumvent or compromise the security of CubiCloud or another provider.
Nothing in this section prohibits legitimate security research, testing, or educational activity conducted with appropriate authorization.
3. Child Sexual Abuse Material
CubiCloud has zero tolerance for child sexual abuse material (CSAM) or any content involving the sexual exploitation of children.
Any discovery or credible report of such material may result in immediate service isolation, suspension, termination, preservation of relevant information, and reporting to appropriate authorities where required or permitted by applicable law.
No refund or advance notice is guaranteed in cases involving serious illegal activity.
4. Network Abuse and Security
The following activities are prohibited unless CubiCloud has provided explicit authorization:
- Port scanning external networks;
- Unauthorized vulnerability scanning;
- Packet sniffing against networks or systems you do not own or control;
- IP spoofing;
- ARP spoofing;
- Unauthorized interception of network traffic;
- BGP manipulation or hijacking attempts;
- Exploitation of third-party infrastructure;
- Launching or coordinating DDoS attacks;
- Operating DDoS-for-hire services;
- Operating stressers or booters;
- Brute-force attacks;
- Deliberately exploiting vulnerabilities in CubiCloud infrastructure; and
- Attempting to bypass network, firewall, authentication, or security controls.
Security testing against your own systems or systems for which you have explicit authorization may be permitted, provided that it does not negatively affect CubiCloud infrastructure or third parties.
If you discover a vulnerability in CubiCloud infrastructure, you should report it through our official support or security contact rather than exploiting it.
5. DDoS and Attack Traffic
CubiCloud Services must not be used to launch, coordinate, amplify, or facilitate denial-of-service attacks.
This includes:
- Distributed denial-of-service attacks;
- UDP/TCP floods;
- Reflection or amplification attacks;
- Application-layer attacks;
- Stress-testing third-party infrastructure without authorization;
- Booter or stresser services; and
- Other traffic intentionally designed to disrupt a third-party service.
A service generating an active attack or presenting an immediate threat to our infrastructure may be isolated or suspended without prior notice.
6. Spam and Email Abuse
The following activities are prohibited:
- Unsolicited bulk email;
- Spam campaigns;
- Purchased or harvested email lists;
- Email spoofing intended to deceive recipients;
- Operating open SMTP relays;
- Operating spam relays;
- Sending malicious or fraudulent email;
- Using hosted applications to distribute spam;
- Deliberately causing IP addresses to become blacklisted; and
- Other abusive email practices.
Customers operating legitimate email infrastructure are responsible for maintaining appropriate authentication and security controls.
CubiCloud may restrict or block outbound SMTP traffic where necessary to protect network reputation and prevent abuse.
7. Cryptocurrency Mining and High-Load Workloads
Cryptocurrency mining, blockchain mining, proof-of-work workloads, or similar continuously intensive workloads are:
- Prohibited on shared hosting and shared game-server infrastructure unless explicitly authorized; and
- Subject to the resource and plan restrictions applicable to VPS, dedicated, or other services.
Customers must not use services in a manner that causes sustained resource consumption that negatively affects other customers or shared infrastructure.
Where a workload is legitimate but exceeds the intended resource profile of a Service, CubiCloud may recommend an appropriate service or resource upgrade.
8. Resource Usage and Fair Use
Customers must operate Services within the resources allocated to their plan.
This includes:
- CPU;
- RAM;
- Storage;
- Disk I/O;
- Network bandwidth;
- Network connections;
- Database resources; and
- Other allocated resources.
Customers must not intentionally consume resources in a manner designed to degrade infrastructure or negatively affect other customers.
For shared infrastructure, sustained excessive resource usage may result in:
- A warning;
- Resource restrictions;
- Temporary throttling;
- Service isolation;
- A request to upgrade to an appropriate plan; or
- Suspension or termination in severe or repeated cases.
Resource limits defined by a specific Service or plan take precedence over general fair-use provisions.
9. Web Hosting
For web hosting services, customers must not use hosting accounts primarily as:
- Public file-storage services unrelated to a website;
- Download mirrors;
- Torrent trackers;
- Seedboxes;
- Proxy networks;
- Cryptocurrency mining systems;
- Spam platforms;
- Malware distribution platforms;
- Phishing platforms; or
- Other services that place unreasonable loads on shared infrastructure.
Web applications must be configured responsibly and must not continuously consume excessive CPU, RAM, disk I/O, database connections, or other shared resources.
10. Game Server Hosting
For Minecraft and other game server hosting services, customers must not:
- Run DDoS or network attack tools;
- Intentionally overload the host node;
- Use exploits to escape container or service isolation;
- Attempt to compromise the hosting panel or node;
- Distribute malware through game servers;
- Host or distribute pirated game clients or unauthorized software;
- Operate malicious bot networks;
- Intentionally crash or disrupt other game servers;
- Coordinate attacks against other servers; or
- Use custom plugins, mods, scripts, or configurations to circumvent infrastructure restrictions.
Customers are responsible for the plugins, mods, server software, scripts, and other content they install.
11. VPS/VDS and Root Access
Customers with root or administrative access are responsible for securing their own virtual servers.
This includes:
- Installing security updates;
- Maintaining appropriate firewall rules;
- Securing SSH and other remote-access services;
- Protecting authentication credentials;
- Monitoring applications;
- Removing compromised software;
- Maintaining backups; and
- Preventing abuse originating from the server.
VPS/VDS services must not be used for:
- Botnets;
- DDoS-for-hire services;
- Spam operations;
- Open proxy services used for abuse;
- Malicious scanning;
- Brute-force attacks;
- Malware distribution;
- Fraud operations;
- Unauthorized penetration testing;
- Network attacks; or
- Other prohibited activities listed in this AUP.
A compromised VPS that is actively attacking other systems or significantly affecting our network may be suspended or isolated immediately.
12. Dedicated Resources and Servers
Dedicated or isolated resources do not exempt customers from this AUP.
Customers using dedicated servers or dedicated resources may not use them for:
- Network attacks;
- Spam operations;
- Fraud;
- Malware distribution;
- Unauthorized penetration testing;
- Illegal marketplaces;
- Reputation manipulation;
- DDoS-for-hire services; or
- Other prohibited activities.
Customers remain responsible for securing and monitoring systems under their control.
13. Dedicated IP Addresses
Dedicated IP addresses provided by CubiCloud must be used responsibly.
Customers must not intentionally use dedicated IP addresses for:
- Spam;
- Fraud;
- Botnets;
- Malicious proxy services;
- DDoS attacks;
- Black-hat activities;
- Reputation manipulation; or
- Other prohibited activities.
CubiCloud may replace, suspend, or revoke an IP address where necessary due to abuse, security issues, upstream requirements, or network reputation concerns.
IP addresses assigned by CubiCloud remain subject to our allocation and network policies and are not permanently owned by the customer unless explicitly agreed otherwise.
14. Peer-to-Peer and Torrenting
Peer-to-peer traffic may be permitted on Services where technically and contractually appropriate, provided that the activity is lawful and does not violate this AUP.
Customers remain responsible for all content distributed through their Services.
The following are prohibited:
- Distribution of unauthorized copyrighted material;
- Malware distribution;
- Illegal software distribution;
- Stolen data distribution;
- Illicit content; and
- Using CubiCloud infrastructure to facilitate unlawful activity.
Verified abuse reports or legal complaints may result in service action.
15. Copyright and Intellectual Property
Customers must respect the intellectual property rights of others.
You may not use CubiCloud Services to knowingly host, distribute, or facilitate unauthorized:
- Copyrighted material;
- Software;
- Games or game clients;
- Movies;
- Music;
- Books;
- Trademarks;
- Proprietary data; or
- Other protected intellectual property.
CubiCloud may investigate credible infringement reports and may take appropriate action where supported by applicable law, contractual obligations, or available evidence.
16. Abuse Reports
Abuse reports should contain enough information for CubiCloud to investigate the alleged activity.
Where possible, reports should include:
- Source IP address;
- Destination IP address;
- Domain or URL;
- Relevant timestamps;
- Description of the alleged abuse;
- Logs or technical evidence; and
- Contact information for the reporting party.
Reports may be submitted through:

CubiCloud may contact the affected customer when appropriate.
17. Customer Cooperation
Customers may be required to cooperate with reasonable investigations involving:
- Security incidents;
- Network abuse;
- Malware;
- Spam;
- Copyright complaints;
- Fraud;
- Compromised systems; or
- Other violations of this AUP.
Failure to respond to reasonable abuse-related requests may result in temporary restrictions or suspension where necessary to protect our infrastructure or other customers.
18. Security Incidents
CubiCloud may immediately restrict, isolate, or suspend a Service when we reasonably determine that it:
- Has been compromised;
- Is actively attacking another system;
- Is distributing malware;
- Is participating in a botnet;
- Is generating severe abusive traffic;
- Poses an immediate threat to our infrastructure; or
- Creates a significant risk to other customers or third parties.
In urgent security situations, prior notice may not be possible.
19. Content Responsibility
CubiCloud provides infrastructure and hosting services. Customers remain responsible for content uploaded, stored, transmitted, or processed through their Services.
You must ensure that your content and activities comply with:
- Applicable laws;
- This AUP;
- Our Terms of Service; and
- Any additional Service-specific policies.
CubiCloud does not generally pre-screen customer content.
20. Staff and Support Conduct
Customers must communicate with CubiCloud employees, contractors, and support personnel respectfully.
The following may result in disciplinary action:
- Threats;
- Harassment;
- Abusive behavior;
- Discriminatory abuse;
- Repeated personal attacks;
- Attempts to intimidate staff;
- Extortion or coercion;
- Spam or flooding of support channels; and
- Deliberate disruption of support operations.
Reasonable criticism, complaints, and disagreements are permitted.
21. Circumvention and Evasion
Customers must not attempt to circumvent:
- Resource limits;
- Account restrictions;
- Service suspensions;
- Network controls;
- Security mechanisms;
- Rate limits;
- Billing systems;
- Authentication systems; or
- Other technical or administrative controls.
Creating multiple accounts or services for the purpose of bypassing an enforcement action may result in additional account or service termination.
22. Enforcement
CubiCloud may take action based on the severity, frequency, and circumstances of a violation.
Possible actions include:
- Informal warning;
- Formal warning;
- Request for corrective action;
- Content or service restriction;
- Network restriction;
- Resource throttling;
- IP replacement or restriction;
- Temporary suspension;
- Immediate emergency suspension;
- Permanent termination;
- Account termination; and
- Reporting to appropriate authorities.
CubiCloud may take immediate action when necessary to protect our infrastructure, customers, third parties, or comply with legal obligations.
Not every violation will receive a warning before enforcement.
23. No Guarantee of Advance Notice
While CubiCloud may generally attempt to notify customers before taking enforcement action, advance notice is not guaranteed.
Immediate action may be taken where:
- There is an active security threat;
- A service is participating in an attack;
- Illegal activity is suspected;
- Infrastructure or other customers are at risk;
- A legal obligation requires immediate action; or
- Delay would materially increase the potential harm.
24. Refunds Following AUP Violations
Services suspended or terminated due to a serious or material violation of this AUP may not be eligible for a refund, subject to applicable law and the applicable provisions of our Terms of Service.
Any remaining account credit may also be subject to the applicable refund and account-credit rules.
25. Policy Changes
CubiCloud may update this Acceptable Use Policy from time to time to reflect changes in our Services, infrastructure, security requirements, legal obligations, or operational practices.
The updated policy will be published on our website with a revised "Last Updated" date.
Continued use of the Services after an updated policy becomes effective constitutes acceptance of the revised policy, subject to applicable law.
