Terms of Service
Clear guidelines for using our services. Please read these terms carefully before proceeding.
Table of Contents
These Terms of Service ("Terms") govern your access to and use of CubiCloud's website, client portal, APIs, hosting infrastructure, servers, and related products and services (collectively, the "Services").
By creating an account, placing an order, making a payment, or otherwise using any CubiCloud Service, you acknowledge that you have read, understood, and agreed to these Terms, together with any applicable Privacy Policy, Acceptable Use Policy, Refund Policy, Service Level Agreement, and other policies referenced by CubiCloud.
If you do not agree to these Terms, you must not create an account or use our Services.
1. Definitions
For purposes of these Terms:
- "CubiCloud," "we," "us," or "our" means CubiCloud and the entity operating the relevant Service.
- "Customer," "Client," "User," "you," or "your" means any individual or organization accessing or purchasing our Services.
- "Account" means the customer account registered with CubiCloud.
- "Services" means any hosting, infrastructure, networking, domain, IP, game server, VPS, web hosting, storage, backup, add-on, API, or related service provided by CubiCloud.
- "Server" means any virtual or physical computing resource provided to you.
- "Content" means any files, software, databases, websites, applications, configurations, data, or other material uploaded, stored, transmitted, or hosted through our Services.
- "Billing Cycle" means the period for which a Service has been purchased, such as hourly, monthly, quarterly, annually, or another period specified at checkout.
- "Service Suspension" means temporarily restricting access to a Service without necessarily terminating the underlying account.
- "Service Termination" means permanently ending a Service or account.
2. Acceptance and Eligibility
2.1 Acceptance
These Terms constitute an agreement between you and CubiCloud. By using our Services, you agree to comply with these Terms and all policies incorporated into them.
2.2 Age Requirement
You must be at least 18 years old, or the minimum legal age required to enter into a binding agreement in your jurisdiction.
If you are below the applicable legal age, you may only use our Services with the involvement and authorization of a parent or legal guardian where permitted by applicable law.
2.3 Business Accounts
If you purchase or use Services on behalf of a company, organization, or other legal entity, you represent that you have the authority to bind that entity to these Terms.
2.4 Restricted Use
CubiCloud may refuse service, restrict access, or request additional verification where reasonably necessary for security, fraud prevention, legal compliance, or protection of our infrastructure.
3. Account Registration and Security
You must provide accurate, complete, and current information when creating and maintaining your Account.
You must not:
- Create an account using false or misleading information.
- Impersonate another person or organization.
- Use another person's payment information without authorization.
- Create multiple accounts to bypass restrictions, suspensions, limits, promotions, or other controls.
- Sell, transfer, or otherwise provide access to your Account without our authorization.
You are responsible for maintaining the confidentiality of your login credentials, API keys, passwords, recovery methods, and other authentication information.
You are responsible for all activity performed through your Account unless you can demonstrate that the activity occurred due to circumstances outside your reasonable control.
You must notify CubiCloud promptly if you suspect unauthorized access to your Account.
CubiCloud may require identity or payment verification before activating certain Services or processing certain transactions.
4. Services
CubiCloud may provide various infrastructure and hosting products, including but not limited to:
- Minecraft and other game hosting
- VPS and VDS hosting
- Dedicated or semi-dedicated infrastructure
- Web hosting
- Domain
- Storage services
- Dedicated IP addresses
- Domain-related services
- Networking and infrastructure services
- APIs and automation services
- Additional products, add-ons, and services introduced from time to time
The exact specifications, limitations, pricing, resource allocations, and features of a Service are determined by the product description or order information applicable to that Service.
CubiCloud may modify, replace, upgrade, or discontinue products or features where reasonably necessary. Where a material change affects an active paid Service, we may provide reasonable notice where practicable.
All Services are provided on an "as available" basis except where a separate written SLA expressly provides otherwise.
Purchasing a Service gives you a right to use the allocated resources for the applicable billing period. It does not grant ownership of CubiCloud's physical servers, network equipment, IP address space, software, facilities, or infrastructure.
5. Resource Allocation and Fair Use
You must use your allocated resources reasonably and within the specifications of your purchased Service.
Depending on the Service, resources may include:
- CPU
- RAM
- Storage
- Disk I/O
- Network bandwidth
- Network connections
- IP addresses
- Database resources
- Other infrastructure resources
Resource limits specified for a Service are not automatically transferable between Services or Accounts.
CubiCloud may take reasonable action where a Service:
- Consistently exceeds its allocated resources.
- Causes instability to shared infrastructure.
- Negatively affects other customers.
- Generates abnormal network traffic.
- Causes excessive disk I/O or network connections.
- Is used to circumvent resource limitations.
Possible actions include throttling, resource adjustment, temporary suspension, migration, or termination depending on the circumstances.
6. Game Server Services
For game hosting Services, the Customer is responsible for:
- Game configuration.
- Plugins and modifications.
- Mods and third-party software.
- Server permissions.
- Player management.
- Server administration.
- Content hosted on the server.
- Maintaining appropriate backups.
CubiCloud does not guarantee compatibility with every game modification, plugin, modpack, third-party application, or custom configuration.
Performance can vary depending on the game, server software, plugins, modifications, player count, world size, configuration, and workload.
7. VPS, VDS and Root Access
Where a Service provides root, administrator, SSH, RDP, or equivalent privileged access, you are responsible for managing the system.
This includes:
- Operating system updates.
- Firewall configuration.
- Password management.
- SSH/RDP security.
- Application security.
- Malware prevention.
- User management.
- Software updates.
- Server configuration.
CubiCloud is not responsible for security incidents resulting from customer configuration, outdated software, weak credentials, exposed services, or insecure applications.
Unless explicitly included in your Service, CubiCloud does not provide managed system administration.
A VPS or VDS may be suspended where it is compromised, participates in attacks, generates abusive traffic, or presents a significant risk to our infrastructure or network.
8. Billing and Payments
Unless otherwise specified, Services are prepaid.
A Service is normally activated after payment has been successfully received and verified.
You are responsible for:
- Paying invoices by their due dates.
- Maintaining sufficient account credit where applicable.
- Monitoring active Services.
- Monitoring renewal dates.
- Maintaining a valid payment method where applicable.
- Keeping your registered email address operational.
- Reviewing invoices and account notifications.
Failure to receive an email does not automatically remove your responsibility to pay an invoice or renew a Service.
Unpaid invoices may result in:
- Service suspension;
- Service termination;
- Removal of allocated resources;
- Permanent deletion of associated data.
Once a Service has been terminated and its data has been deleted, CubiCloud may be unable to restore the Service or its contents.
9. Automatic Renewal and Recurring Services
Where automatic renewal is enabled, the Service may renew automatically according to the selected billing period.
You are responsible for ensuring that sufficient funds or account credit are available.
If automatic renewal fails, CubiCloud may suspend the Service after the applicable payment deadline.
Customers wishing to prevent renewal must cancel the Service before the renewal date through the available client portal or by contacting support where applicable.
Cancellation of a Service does not automatically entitle the Customer to a refund for the unused portion of the current billing period unless otherwise stated in our Refund Policy.
10. Refunds and Credits
Refund eligibility is governed by CubiCloud's Refund Policy.
Unless expressly stated otherwise, payment for a Service does not create an automatic right to a refund.
Refund eligibility may depend on:
- The type of Service purchased.
- The time elapsed since purchase.
- Whether the Service has been used.
- Whether a technical issue can be verified.
- Whether the issue was caused by CubiCloud.
- Whether the Customer has previously received a refund.
- Whether the Service is specifically excluded from refunds.
The following may be non-refundable where specified by our Refund Policy:
- Domain registrations and renewals.
- Dedicated IP addresses.
- Setup or installation fees.
- Certain VPS/VDS products.
- Custom services.
- Third-party products.
- Add-ons.
- Services suspended or terminated because of policy violations.
- Services consumed through usage-based or hourly billing.
- Payments made using account credit where otherwise specified.
Refunds, where approved, may be issued to the original payment method or as account credit at CubiCloud's discretion and subject to payment-provider limitations.
Please refer to the separate Refund Policy for the complete refund rules.
11. Account Credit and Wallet Balance
Where CubiCloud provides account credit, wallet, or prepaid balance functionality:
- Account credit may only be used for eligible Services.
- Account credit is not a bank account or deposit account.
- Account credit cannot be transferred between users unless explicitly permitted.
- Account credit may not be sold or exchanged for cash.
- Promotional credits may have additional expiration or usage restrictions.
- CubiCloud may reverse fraudulent or incorrectly issued credits.
Unless required by applicable law or expressly stated in our Refund Policy, unused promotional credit is not refundable.
12. Hourly or Usage-Based Billing
Where a Service is billed based on usage, including hourly billing:
- Charges are calculated according to the applicable pricing displayed when the Service is purchased.
- Usage may continue to generate charges while the Service remains active.
- You are responsible for maintaining sufficient account balance.
- Insufficient balance may result in automatic suspension or termination.
- Stopping or deleting a Service may stop future usage charges but does not necessarily reverse charges already incurred.
- Billing records generated by CubiCloud's systems will be considered authoritative unless a billing error is demonstrated.
Customers using usage-based Services are responsible for monitoring their balance and active resources.
13. Chargebacks and Payment Disputes
Customers should contact CubiCloud support before initiating a payment dispute where the issue can reasonably be resolved through support.
Unauthorized chargebacks, fraudulent payment disputes, or payment reversals may result in:
- Immediate Service suspension.
- Account restriction.
- Termination of affected Services.
- Reversal of promotional credits.
- Recovery of outstanding balances.
- Referral of suspected fraud to appropriate payment providers or authorities where required.
This section does not prevent you from exercising rights available under applicable law.
14. Acceptable Use
You may not use CubiCloud Services for unlawful, abusive, fraudulent, malicious, or harmful activities.
Prohibited activities include, but are not limited to:
- Malware distribution.
- Phishing.
- Credential theft.
- Botnets.
- DDoS attacks.
- DDoS-for-hire services.
- Unauthorized access to systems.
- Exploitation of third-party systems.
- Spam or unsolicited bulk messaging.
- Fraud or scams.
- Carding or payment fraud.
- Distribution of stolen credentials.
- Copyright infringement.
- Distribution of illegal content.
- Activities intended to evade law enforcement or security controls.
- Hosting infrastructure used primarily for malicious activity.
- Deliberate attacks against CubiCloud or third-party infrastructure.
You must comply with all applicable laws and regulations.
CubiCloud may investigate suspected abuse and may take action necessary to protect our infrastructure, customers, network, and third parties.
15. Network Abuse and Security Incidents
You are responsible for activity originating from your Services.
If your Service is compromised and begins generating malicious or abusive traffic, you must take reasonable steps to secure it.
Depending on the severity of an incident, CubiCloud may:
- Notify you of the incident.
- Request remediation.
- Temporarily block traffic.
- Suspend network access.
- Suspend the affected Service.
- Terminate the Service.
- Preserve relevant logs.
- Cooperate with legitimate abuse investigations or legal requests.
Where immediate action is required to protect our network or other customers, prior notice may not be possible.
16. Abuse Complaints
CubiCloud may receive abuse reports from network operators, security researchers, copyright holders, law enforcement agencies, or other parties.
Where appropriate, we may forward the complaint to the affected Customer and request remediation.
Customers are expected to respond to legitimate abuse reports within a reasonable period specified by CubiCloud.
Failure to address repeated or serious abuse may result in suspension or termination.
CubiCloud may take immediate action without waiting for a Customer response where the reported activity presents an immediate security, legal, or operational risk.
17. Content and Customer Responsibility
You retain responsibility for Content you upload, store, process, or transmit through our Services.
You represent that you have the necessary rights and permissions to use such Content.
CubiCloud does not claim ownership of your Content merely because it is hosted on our infrastructure.
However, you grant CubiCloud the limited rights necessary to store, process, transmit, copy, and technically handle your Content solely for the purpose of providing the Services.
You are responsible for ensuring that your Content does not violate these Terms, applicable laws, or the rights of third parties.
18. Data Protection and Privacy
CubiCloud's handling of personal information is described in our Privacy Policy.
We may process information necessary to:
- Create and maintain customer accounts.
- Process payments.
- Provide and maintain Services.
- Prevent fraud and abuse.
- Provide customer support.
- Maintain security.
- Comply with legal obligations.
We may disclose information where required by applicable law, court order, legal process, or legitimate governmental request.
You are responsible for protecting personal information that you store or process through your Services.
19. Backups and Data Loss
Customers are responsible for maintaining independent backups of their data.
Unless a specific backup product or written agreement states otherwise, CubiCloud does not guarantee that backups exist or that data can be restored after loss.
Data may be lost because of:
- Hardware failure.
- Software failure.
- Storage failure.
- Customer error.
- Accidental deletion.
- Malware.
- Security incidents.
- Configuration errors.
- Service termination.
- Infrastructure failure.
- Natural disasters or other events outside our reasonable control.
Where CubiCloud provides backups as part of a Service, such backups should be considered a recovery mechanism and not a replacement for independent customer backups.
20. Service Availability and SLA
CubiCloud aims to maintain reliable and stable infrastructure.
Where a specific Service Level Agreement applies, the uptime commitment, exclusions, measurement method, and compensation will be defined by the applicable SLA.
Unless expressly covered by an SLA, uptime is not guaranteed.
Downtime caused by circumstances outside CubiCloud's reasonable control or circumstances attributable to the Customer may be excluded from uptime calculations.
Examples may include:
- Scheduled maintenance.
- Emergency maintenance.
- Customer configuration.
- Application or plugin failures.
- Game-server software issues.
- DDoS attacks.
- Third-party network failures.
- Upstream provider failures.
- Internet routing problems.
- Force majeure events.
Any SLA credits are the Customer's exclusive remedy for qualifying downtime where the applicable SLA states otherwise.
21. Maintenance and Infrastructure Changes
CubiCloud may perform scheduled or emergency maintenance.
Maintenance may involve:
- Server migration.
- Hardware replacement.
- Network maintenance.
- Software upgrades.
- Security updates.
- Data-center maintenance.
- Infrastructure optimization.
We will make reasonable efforts to provide advance notice of scheduled maintenance when practical.
Emergency maintenance may occur without advance notice where necessary to protect infrastructure, security, or service stability.
CubiCloud may migrate Services between physical servers, data centers, networks, or infrastructure providers where reasonably necessary.
22. Dedicated IP Addresses
IP addresses assigned to customers remain the property of CubiCloud, our upstream provider, or the relevant Internet registry/authority.
Assignment of an IP address does not create ownership rights.
You must not:
- Sell an assigned IP address.
- Transfer an IP address without authorization.
- Use an IP address for abusive activity.
- Intentionally damage the reputation of an assigned IP.
- Attempt to claim ownership over the IP allocation.
CubiCloud may change or revoke an IP address where reasonably necessary for security, networking, abuse prevention, infrastructure changes, or upstream requirements.
Where an IP is revoked because of Customer abuse or policy violations, no refund is necessarily owed.
23. Domains and Third-Party Services
Domain registrations and other third-party services may be subject to additional terms imposed by registrars, registries, payment providers, software developers, data centers, or other providers.
Where a third-party service is involved, you agree to comply with its applicable policies.
Domain registration fees may be non-refundable once registration or renewal has been successfully completed.
CubiCloud is not responsible for changes to third-party services, policies, pricing, availability, or infrastructure outside our control.
24. Third-Party Software
Some Services may include or support third-party software such as operating systems, control panels, game server software, plugins, applications, or open-source projects.
Third-party software may be governed by its own licenses and terms.
CubiCloud does not guarantee that third-party software will remain available, compatible, secure, or supported.
You are responsible for complying with applicable third-party licenses.
25. Affiliate Program
Where CubiCloud operates an affiliate program:
- Self-referrals may be prohibited.
- Fraudulent referrals are prohibited.
- Artificial traffic or automated referrals are prohibited.
- Affiliate commissions may be reversed where an underlying transaction is refunded or charged back.
- Affiliates must not make false claims about CubiCloud.
- Affiliates must not represent themselves as CubiCloud employees or official representatives unless authorized.
- CubiCloud may suspend or terminate affiliate accounts involved in abuse.
Additional affiliate rules may apply to the specific affiliate program.
26. Reselling
Customers may not resell, sublicense, or commercially redistribute CubiCloud Services where the applicable product explicitly prohibits resale.
Where CubiCloud offers an authorized reseller program, resellers must comply with the applicable reseller agreement.
Unless otherwise agreed in writing, the original account holder remains responsible for activity conducted through Services purchased under their Account.
27. Staff Conduct and Customer Communication
CubiCloud expects customers and staff to communicate professionally.
We do not tolerate:
- Threats.
- Harassment.
- Hate speech.
- Personal attacks.
- Extortion.
- Repeated abusive behavior.
- Attempts to intimidate staff.
- Threats of violence.
- Doxxing or publication of private staff information.
Reasonable criticism, complaints, refund requests, and disagreements are permitted.
However, abusive conduct that creates a safety or operational concern may result in restrictions on support access or account action.
CubiCloud may take proportionate action depending on the circumstances.
28. Intellectual Property
CubiCloud's website, branding, logos, designs, software, control panels, documentation, interfaces, and proprietary systems are owned by or licensed to CubiCloud and are protected by applicable intellectual-property laws.
Except where expressly permitted, you may not:
- Copy our branding.
- Reproduce proprietary website designs.
- Reverse engineer proprietary software.
- Redistribute proprietary systems.
- Remove proprietary notices.
- Misrepresent CubiCloud's services as your own.
Nothing in these Terms transfers ownership of CubiCloud intellectual property to you.
29. Suspension
CubiCloud may temporarily suspend a Service or Account where reasonably necessary due to:
- Non-payment.
- Terms violations.
- Abuse complaints.
- Security threats.
- Fraud.
- Excessive resource usage.
- Network abuse.
- Legal requirements.
- Compromised infrastructure.
- Risks to other customers.
- Requests from legitimate authorities or upstream providers.
Where practical, we may provide notice and an opportunity to resolve the issue.
Immediate suspension may occur without prior notice when delay could cause significant harm.
30. Termination
You may terminate a Service through the client portal or by following the applicable cancellation process.
CubiCloud may terminate a Service or Account where:
- You materially violate these Terms.
- You repeatedly violate our policies.
- You fail to pay amounts due.
- You engage in fraud.
- You conduct prohibited activities.
- Your Services create a significant security or network risk.
- Termination is required by law or an upstream provider.
- Continued service becomes commercially or technically impractical.
Termination resulting from Customer misconduct does not automatically create a right to a refund.
Following termination, CubiCloud may permanently delete associated data after the applicable retention period.
Customers should download their data before cancellation, suspension, or termination.
31. Data Retention After Termination
After a Service is terminated, CubiCloud may retain or delete data according to its operational requirements, backup cycles, legal obligations, and Privacy Policy.
Unless otherwise stated, customers should assume that data associated with terminated Services may eventually be permanently deleted.
CubiCloud is not obligated to retain customer data indefinitely.
32. Limitation of Liability
To the maximum extent permitted by applicable law, CubiCloud will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including:
- Loss of profits.
- Loss of revenue.
- Loss of business opportunities.
- Loss of customers.
- Loss of reputation.
- Loss of data.
- Loss of anticipated savings.
- Business interruption.
CubiCloud is not responsible for losses caused by third-party providers, Internet outages, customer configuration, customer negligence, compromised credentials, unsupported software, or events outside our reasonable control.
To the maximum extent permitted by law, CubiCloud's aggregate liability arising from a Service will be limited to the amount actually paid by the Customer for the affected Service during the [30/90] days immediately preceding the event giving rise to the claim.
Nothing in these Terms excludes liability that cannot legally be excluded or limited under applicable law.
33. Indemnification
To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless CubiCloud, its operators, employees, contractors, and service providers from claims, damages, liabilities, costs, and reasonable legal expenses arising from:
- Your use of the Services.
- Your Content.
- Your violation of these Terms.
- Your violation of applicable law.
- Your violation of third-party rights.
- Activities conducted through your Account.
This obligation does not apply to the extent that a claim is caused by CubiCloud's own unlawful conduct or liability that cannot legally be transferred to you.
34. Force Majeure
CubiCloud will not be responsible for delays, interruptions, or failures caused by circumstances beyond our reasonable control.
Such circumstances may include:
- Natural disasters.
- Earthquakes.
- Floods.
- Fires.
- Severe weather.
- War.
- Civil unrest.
- Government actions.
- Power failures.
- Internet backbone failures.
- Major routing incidents.
- Data-center failures.
- Upstream provider outages.
- Cyberattacks.
- DDoS attacks.
- Telecommunications failures.
- Other events beyond our reasonable control.
We will make reasonable efforts to restore affected Services when practical.
35. Changes to These Terms
CubiCloud may update these Terms from time to time.
When material changes are made, we may provide notice through the website, client portal, email, or another reasonable communication method.
The updated Terms will become effective on the date stated in the revised Terms.
Continued use of the Services after the effective date of revised Terms constitutes acceptance of the updated Terms to the extent permitted by applicable law.
36. Severability
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be interpreted or modified to the minimum extent necessary to make it enforceable where permitted by law.
The remaining provisions will continue in full force and effect.
37. No Waiver
Failure by CubiCloud to enforce any provision of these Terms does not constitute a waiver of our right to enforce that provision in the future.
Any waiver must be expressly provided by an authorized representative of CubiCloud.
38. Entire Agreement
These Terms, together with any applicable:
- Privacy Policy;
- Acceptable Use Policy;
- Refund Policy;
- Service Level Agreement;
- Product-specific terms;
- Reseller agreements;
- Affiliate terms; and
- Other policies expressly incorporated by reference
constitute the agreement governing your use of the applicable Services.
Where a specific written agreement conflicts with these Terms, the specific agreement will control to the extent of the conflict.
39. Governing Law and Disputes
These Terms shall be governed by the laws of India, without regard to conflict-of-law principles.
Any dispute arising from these Terms or the Services shall first be submitted to CubiCloud for good-faith resolution.
Nothing in this section prevents either party from exercising rights or remedies that cannot legally be waived.
